Terms and Conditions of DEI blue® eMobility Services via Application (for mobile devices)

1. CONTRACTUAL RELATIONSHIP
1.1. This document (together with any other document referred to herein) sets out the Terms and Conditions (hereinafter the "Terms") governing the provision of eMobility services and the access and use by the End User of any applications, websites, content, products and services made available by DEI blue® (the "Services"). These Terms are available on both the application and the Website DEI blue®, from where they can be downloaded in PDF format.
1.2. Please read the Terms carefully and use the DEI blue® Services only if you agree with these terms. By using the DEI blue® Services you agree to these Terms, you declare that you are over the age of 18 years and that you have the legal capacity to enter into binding contracts and the authority to accept these Terms. Through your use of the Services a contractual relationship between you and PPC S.A. (hereinafter " DEI blue® Service Agreement") is established. These Terms constitute the DEI blue® Service Agreement that you enter into with PPC S.A. and cover both your existing and any future contractual obligations.
1.3. PPC S.A. may amend these Terms and the relevant amendments shall enter into force as from the date of their publication on the application and the Website DEI blue®. It is recommended that you regularly check these Terms, because by continuing to use our Services following any amendment to these Terms, you shall be deemed to have consented to such amendment.
2. OUR DETAILS
The DEI blue® Services are provided by the societe anonyme under the tradename "PUBLIC POWER CORPORATION S.A.", registered with the General Electronic Commercial Registry of Greece with registration number 00078601000, having its registered seat in Athens, 30 Chalkokondyli st., GR 10432, Athens, Greece and with TIN number 090000045, as legally represented.
3. SCOPE OF THE AGREEMENT - DEI blue® SERVICES
By the DEI blue® Service Agreement and in accordance with the provisions of these Terms and Conditions, PPC S.A.:
(a) grants you the license to use the PPC blue App, which is limited to the Greek Territory, is non-exclusive, personal, non-transferable, non-sub-licensable and subject to the restrictions provided below. Detailed instructions for the installation and use of the application can be found in Annex A' of the present Terms, which constitute an integral part thereof.
(b) enables you to use each Network Charging Point to carry out Charging Sessions for your Electric Vehicle (EV), subject to the provisions of the Safe Charging Rules, as well as electromobility services through special functionalities, such as trip planning with suggestions for on-route charging stops, connecting your EV to the app to monitor in real time your vehicle battery health and receive relevant automatic updates, as well as reserving a charging plug on a DEI blue® charging station (for a few minutes before your arrival) exclusively for charging your EV, to ensure optimal charging scheduling.
4. DEFINITIONS
4.1 Force Majeure: any event independent of PPC’s will and sphere of influence, that cannot be prevented by taking any diligent or prudent measures such as (including but not limited to) earthquake, fire, flood, war, epidemics, strike, etc. PPC shall not be liable for failure to perform its obligations arising from the DEI blue® Service Agreement for the duration of the Force Majeure Event.
4.2 Network: the total number of Charging Points of PPC S.A. with the distinctive features and the trademark of the DEI blue® (hereinafter DEI blue Network) which are at the disposal of End Users for the purpose of charging their Electric Vehicles using the PPC blue App.
4.3 Member: the Εnd User who has installed the PPC blue Application and at the same time has registered/created an Account/Profile in it, in order to make charging sessions at preferential rates, based on the applicable Tariff Policy, and to enjoy the privileges of using the PPC blue Application functions connected to the Account/Profile (hereinafter Member or Registered User).
4.4 Guest User: the End User who has installed the PPC blue Application and has not created an Account/Profile in it, has access to the charging points of DEI blue®
Network and can make charging sessions based on the standard tariffs of the applicable Tariff Policy posted on DEI blue® website.
4.5 PPC blue App: the mobile application for IOS and Android software provided by PPC by which End Users gain access to the Charging Infrastructure and use the Services. The App is compatible with any mobile electronic device, which has internet access.
4.6 “Electric vehicle” or “EV”: any motor vehicle equipped with a power train including at least one non-peripheral, external, auxiliary, electric motor operating as energy converter with an electrically rechargeable energy storage system which is externally recharged.
4.7 Private charger: the device and all electrical equipment, capable of charging the battery of an electric (powered with electricity) vehicle, installed in places without public access and intended for private use of EV charging.
4.8 DEI blue® Services Website: the Website https://www.deiblue.gr https://www.deiblue.com providing information to potential customers on DEI blue® charging network of PPC S.A. and on the eMobility services offered by PPC.
4.9 Operational Charging Point: any Charging Point of the DEI blue® Network that is displayed in the PPC blue App database, the operation of which can be activated.
4.10 Account/Profile: the part of the PPC blue App that is reserved exclusively for the Members/Registered Users of DEI blue® Services of PPC S.A. When the End User creates an Account: (a) his/her data are identified, both when logging in to the PPC blue App and when carrying out a Charging Session; (b) he/she enjoys preferential charging rates throughout the DEI blue® Network based on the relevant applicable Tariff Policy posted on the DEI blue® Website, (c) payment of his/her charging sessions is made easier by having access to various payment methods and (d) he/she has access to functionalities of the PPC blue App related to the provision of special E-mobility services.
4.11 Non-operational charging point: charging point of the DEI blue® Network that is displayed in the PPC blue App database, but its operation cannot be activated for any reason whatsoever.
4.12 Terms: these Terms and Conditions, including any other document referred to herein, governing the End User's access to and use of any applications, websites, content, products and Services made available with the distinctive features and the trademark of the DEI blue® by PPC S.A.
4.13 eMobility Service Provider or “EΜSP”: any private business or legal entity active in the provision of eMobility services to End Users, in this case PPC S.A., which manages the Charging Infrastructures.
4.14 Tariff Policy: the current policy applied by PPC S.A. for the charging of DEI blue® Services which is posted on the official DEI blue® website and reflects the current applicable tariffs corresponding to each DEI blue® Service used by the End User.
4.15 Charging Point: interface, capable of charging at least one EV per session.
4.15 Charging Station/Infrastructure: the overall electrical equipment capable of charging the battery of an electric (powered with electricity) vehicle, including the hardware and software, PPC’s trade name, distinctive signs and trademarks, and all supporting equipment and constructions, including, without limitation, concrete coatings and safety pillars.
4.16 DEI blue® Service Agreement: the present Terms that you accept in order to receive DEI blue® Services of PPC S.A. through the PPC blue App.
4.17 Charging Session: a session during which an Electric Vehicle is charged at any Operational Charging Point of the DEI blue® Network by using the PPC blue App.
4.18 End User: the person, who has installed the PPC blue App and wishes to access the Charging Station/Infrastructure.
4.19 Termination of charging session: the termination of a charging session either at the initiative of the End User through the PPC blue Application, or automatically when the EV battery is fully charged.
4.20 DEI blue® Services: the services provided by PPC S.A. to the EV End Users via the PPC blue App in connection with the EV charging session, pricing and other session-related functionalities, and/or in parallel with additional services related to EMoblity aiming at providing optimal service to EV users (hereinafter Services or Charging Services or DEI blue® Services).
5. DURATION OF THE AGREEMENT
The provision of DEI blue® Services is governed by these Terms, which you accept each time you use the PPC blue App.
6. TERMINATION
6.1 The provision of the DEI blue® Services has a limited duration and is therefore terminated at the end of each Charging Session and the payment of the Charging Session price.
6.2 PPC S.A. reserves the right to discontinue the use of the Services and/or the Application as set forth below.
7. RULES FOR SAFE CHARGING
7.1 It is not allowed to use the DEI blue® Services for any activities other than their intended use.
7.2 Each Charging Point of DEI blue® is intended solely for charging Electric Vehicles. Thus, it is prohibited to connect any other devices (e.g. electric tools, electric bikes/scooters, etc.).
7.3 Before starting a Charging Session, you must have read and understood the Rules for Safe Charging as set out in Annex B hereof, which constitute an integral part hereof.
7.4 Under no circumstances should you attempt to start a Charging Session if you notice any signs of wear and tear on either the Charging Point or the charging cable. In such case you should immediately move away from the Charging Point. In case you notice any of the above, please report this immediately to DEI blue® customer service, by calling at 800 900 1100, free of charge from a landline or mobile phone, to our authorized partners who receive all relevant requests and provide information. Any calls from foreign mobile phone lines should be made at +30 211 211 0900 and may be subject to charges based on the tariff policy of your telecommunications provider.
8. CHARGING SESSION AND RELATED FUNCTIONALITIES AND SERVICES
8.1 The PPC blue App enables you to start, stop and pay for charging your EV at the publicly accessible Charging Points of DEI blue® network.
8.2 When using the Charging Points, you shall comply with all applicable requirements pertaining to the EV charging process, especially PPC’s requirements as well as the Rules for Safe Charging. In any case, you are required to make proper use without causing any disturbance, inconvenience or material damage to the Charging Station/Infrastructure or to adjacent facilities.
8.3 For the proper use of DEI blue® charging points and for timely vacating the charging bay after the termination of the charging session, so as to be immediately available
to another End User, PPC SA. may impose an overstay fee on all or selected DEI blue® network charging points based on their category (standard charging, fast charging, or ultra-fast charging points) or/and their power size (kW), as determined in the applicable from time-to-time Commercial Policy and Tariff Policy of DEI blue® Services.
8.4 The Charging points to which the overstay fee applies are properly indicated on the display screen of the available charging points of the respective location in the PPC blue Application. A relevant notification for the applicable fee at the selected charging plug will be displayed in the PPC blue Application just before the start of a charging session.
8.5 An End User using a charging point to which the overstay fee applies has thirty (30) minutes, starting from the end of the charging session, to unplug his electric vehicle (EV) from the charging point and move it from the charging bay, without incurring the overstay fee ("grace period"). The End User is informed of the termination of the charging session and the commencement of the grace period by a relevant notification via the PPC blue Application.
8.6 For optimal scheduling and to ensure the availability of charging points for upcoming charging sessions, End Users of PPC blue Application are provided with the “booking” service, which involves reserving a charging plug for a predetermined period of thirty (30) minutes before the arrival of the End User at the location of the selected plug. This service is offered exclusively to DEI blue® Members and allows for as many reservations as the Member wishes per day at charging plugs which are located at different locations/hubs of charging stations of the DEI blue® charging network. Thus, the reservation of a charging plug at a specific location/hub of charging stations can be performed once per day, while it is not possible to reserve multiple charging plugs simultaneously.
The booking service may be provided at all, or selected charging points based on their category (standard charging, fast charging, or ultra-fast charging), or/and based on their power size (kW), as determined in the applicable from time-to-time Commercial Policy and Tariff Policy of DEI blue®. At charging points where booking service is provided, beyond the reservation time period selected by the Member, a "grace period" of five (5) minutes applies for late arrival of the DEI blue® Member at the selected plug bay and no additional charges shall apply.
8.7 You can get detailed information and instructions for procedural, technical and other issues related to the charging session, the overstay fee and the charging plug booking service, by contacting DEI blue® customer service at 800 900 1100 free-of-charge from a landline or mobile phone, by submitting a relevant request to our authorized partners. Calls from international phone numbers should be made at +30 211 211 0900 and may be subject to charges according to the tariff policy of your telecommunications provider.
8.8 PPC S.A. subject to those provided for in article 13 below, shall make every effort to ensure that the Charging Points are always in operation without interruptions and/or failures and available for charging. Otherwise, you will be informed via the Mobile App PPC blue.
8.9 PPC S.A. may withdraw one or more Charging Points at any time and will make every effort to update the Application immediately.
9. USER REGISTRATION AND ACCOUNT CREATION IN THE PPC blue APP
9.1 In order to register in the PPC blue Application ("Member") you must proceed to the creation of an Account.
9.2 The Account is created when the End User logs in to the PPC blue App via Apple or Google or Facebook accounts or when registering an e-mail and creating a username and password to log in to the Account.
9.3 By creating a Member account, you enjoy the preferential rates offered for your EV charging sessions. In addition, you can benefit from additional discounts on the preferential tariffs offered to Members or other offers from DEI blue® through its Partners, as determined by the applicable from time-to-time Commercial Policy and Tariff Policy of DEI blue® Services posted on the official website of DEI blue®.
9.4 As a DEI blue® Member you will enjoy additional privileges provided through the PPC blue App, such as control and management of information about your EV charging sessions, additional payment methods, booking of charging plugs for optimal scheduling of your daily charging sessions, connection of your EV for real-time battery status monitoring, planning of optimal travel routes with suggestions for the necessary on-route Charging Sessions at DEI blue® Network Charging Stations.
9.5 The PPC blue App allows you to easily modify at any time the data entered for the registration and creation of a Member Account, except for the e-mail.
9.6 You may delete your Member Account at any time through the PPC blue App.
10. CHARGING AND RELATED FUNCTIONALITIES AND SERVICES – METHOD OF PAYMENT – PRICING
10.1 The installation and use of the PPC blue App is free-of-charge to all Users.
10.2 The use of the DEI blue® Services is at your expense. Pricing for the use of DEI blue® Charging Points to charge your electric vehicle (EV) is based on the energy received by the EV during charging and is calculated in euros (€) per kilowatt-hour ("kWh"). Pricing of the overstay fee is based initially on the time category that the EV remains connected to the charging plug after the termination of the charging session and after the end of the grace period of thirty (30) minutes, and is calculated in euros (€)/five (5) minutes, and thereafter ˗ after the end of the total thirty-five (35) minute time period and as long as the EV still remains connected to the charging plug - is calculated in euros (€) per minute.
Terms and tariffs for charging the above Services are defined in the applicable from time-to-time Tariff Policy posted on the official DEI blue® website. If the Tariff Policy for the DEI blue® Services is amended, you will be notified of the amendments as set out in clause 1.3 of these Terms.
10.3 Billing support, payments and relevant invoicing are carried out through our authorized partners in the PPC blue App, as detailed below in article 14 hereof.
10.4. To carry out a Charging Session, you must select the mode of payment and enter in a special field the active bank card number (MasterCard, American Express, Visa, Google Pay, Apple Pay). By adding and charging the bank card, you authorize the credit institution that issued it to make payments from your bank accounts.
10.5 Before initiating a Charging Session, the amount of fifteen euros (15€) will be blocked on the bank card that you have entered as payment method, to guarantee the payment. At the end of the charging session, in case its final value exceeds the amount of fifteen euros (15€), your bank card will be charged with the initially blocked 15€ and the extra amount corresponding to the kWh consumed during the specific session. In case the final value of the charging session does not exceed 15€, your bank card will be charged with the exact amount of kWh you consumed, and the remaining blocked amount will be released.
The release of the amount or balance of fifteen euros (15€) is carried out immediately by our authorized partner for the provision of E-Payment Services; the time for the transaction/release to appear on your bank card varies depending on the issuing bank and its settlement period. If there is no fifteen euros (15€) balance on the bank card registered in the application, the charging session will not be initiated. For any dispute or question regarding charges on your card, please contact (within 30 days from the date of the charge) the DEI blue® customer service at 800 900 1100, free of charge, from a landline or mobile phone, or at +30 211 211 0900 if you are calling from a foreign mobile phone.
10.6 Especially Members, beyond the use of bank card or Google/Apple pay account, have the additional possibility to pre-pay specific amounts of their choice, which are solely and exclusively intended for future charging sessions ("wallet balance"). The wallet balance is activated by prepayment of selected amounts (in €) by the Member and relevant debit to the bank card or Google/Apple pay he/she has registered in PPC blue App. In this case, when carrying out charging sessions using an active wallet, the registration of a bank card is not required each time and there will not be fifteen-euro amount blocked to guarantee payment prior to the initiation of the charging session. In addition, for the proper management of wallet, continuous information on its balance is provided through the Member's Account/Profile in the PPC blue App, while notifications are sent by the App for the necessary balance to start charging and for stopping charging sessions in case the available wallet balance is insufficient.
10.7 In order to ensure proper payment process of a charging session, charging will be stopped at a minimum wallet balance, which will remain as an unused amount in the Member's wallet but can however be refunded to the end user under the provisions of para 10.8 below.
10.8 By deleting a Member account on PPC blue Application, any unused balance (in €) of the active wallet is refunded to the bank card or Google/Apple pay account that the end user has registered for the activation of his/her wallet.
10.9 The Member always retains the option not to use the wallet, in which case the recharging services are debited in accordance with the provisions set out in para 10.4 and 10.5.
10.10 The use of the “wallet balance” is available to DEI blue® Members exclusively for debiting charging sessions and not for debiting charging session-related functionalities and services (i.e. the overstay fee).
10.11 The charging plug booking service is available free of charge and only DEI blue® Members.
10.12 The overstay fee for a connected EV to the charging plug after the termination of the charging session is automatically debited, when unplugging the charger from the EV, exclusively to the bank card or Google/Apple pay account registered in the Application by the Member, without prior blocking of the amount of fifteen euros (€15) as verification of sufficient card balance.
10.13 For procedural and other issues related to the billing of the charging session and overstay fee, you may get detailed information and instructions by contacting DEI blue® customer service at 800 900 1100 free of charge from a landline or mobile phone, by submitting a relevant request to our authorized partners. Any calls from foreign mobile phone lines should be made at +30 211 211 0900 and may be subject to charges according to the tariff policy of your telecommunications provider.
11. ADDITIONAL SERVICES PROVIDED VIA PPC blue APP TO MEMBERS
The PPC blue App provides the following additional services to Members in order to provide optimal service to EV users.
11.1 "Cars": vehicles selected by the Registered User are displayed along with their specifications, and possibility of registration/connection of his/her vehicle.
11.2 "EV connect": connection of the ΕV for monitoring at any time the health of the battery and receipt of automatic updates from the Application when recharging is deemed necessary. In order for the Application to retrieve the data of the respective EV, the user's authorization is required through log in to the account (email/password) that he/she has created on the platform of the respective EV manufacturer.
11.3 "Private Charger Connect": connection of the private charger to the App to monitor at any time its status and availability, manage private charging sessions with the ability to start and stop them, schedule them at a later time and calculate their indicative and approximate costs, or even activate the “plug&charge” functionality
to automatically start charging sessions simply by connecting the charging cable between vehicle and charger. In order for the Application to retrieve the data of the respective private charging charger, the user’s authorization is required, through log in to the account (email/password) that he/she has created on the platform of the respective charger manufacturer.
11.4 "PPC blue Trips": trip planning to specific destinations with the possibility of predicting and calculating the optimal and fuel-efficient route, as well as displaying available service areas for rest and EV recharging. This service provides the possibility of calculating in advance the cost and the waiting time at each Charging Station, provided that certain filters (destination, average speed, number of passengers, battery percentage at start-up, etc.) are entered by the user of the Application.
11.5 "Show Traffic": display of real-time road traffic information.
11.6 "Voucher": the Member may enter in a special field of the PPC blue App a discount code provided to him/her by PPC S.A. or the companies cooperating with PPC S.A. exclusively for special discounts on the tariffs of the charging sessions. Voucher discounts do not apply upon tariffs of the overstay fee.
11.7 "History": the Registered User may access the complete history of his/her charging sessions and charging session-related functionalities and services and their debits, as well as download relevant special reports.
12. ADDITIONAL SERVICES PROVIDED VIA PPC blue APP TO GUEST USERS
Guest Users are provided via PPC blue Application the additional services under para 11.5 and 11.7, as well as the service under 11.1 without the additional under 11.2 possibility of connecting an EV.
13. LIABILITY AND LIMITATION OF LIABILITY
13.1 The Services are provided in accordance with the present Terms. PPC S.A. shall be liable for all its representations and obligations expressly included herein. Similarly, you are responsible for the representations and obligations you assume by using the PPC blue App and Services.
13.2 PPC S.A. declares that the provision of the DEI blue® Services and App also depends on third parties and therefore cannot guarantee that they will be provided continuously and uninterruptedly, without failures and/or faults (electricity network, telecommunications network). The usefulness and quality of the PPC blue App also depends on its proper use by the users.
13.3 PPC S.A. is not responsible for any disruptions, delays or errors regarding the EV charging, the proper use, the non-functionality of the Application or other technical faults or damages caused by issues related to the use or operation of DEI blue® Services.
13.4 A prerequisite for the operation of the Charging Points is the operation of the required telecommunications infrastructure, such as mobile phone connections and other internet connections. PPC S.A. bears no responsibility for any failure to access and use the Charging Points or the PPC blue App due to technical issues caused by malfunctions/faults of the respective telecommunications network.
13.5 PPC S.A. is not liable for any damage or loss that you may suffer as a result of your failure to charge (or fully charge) the EV, or as a result of the use or operation of a Charging Point if the reason for such failure is not within its sphere of responsibility. PPC S.A. shall not be liable in the event that the EV cannot be charged (or safely charged) due to a defect in the EV and/or the auxiliary equipment used, such as the charging cables.
13.6 In order to prevent damage or if there is risk of damage or damage has already occurred, PPC S.A. shall take all necessary measures to prevent or limit damage that may reasonably be required.
13.7 PPC S.A. shall not be liable for the fulfilment of any obligation in case of force majeure or in general of occurrence of any event outside its sphere of responsibility.
13.8 As a User of the Charging Infrastructure, you are solely responsible for any damage or loss to the Charging Infrastructure that may occur during the use of a Charging Point due to your fault and you will compensate PPC S.A. and any third parties if the damage or loss is related to them.
14. PERSONAL DATA PROTECTION
14.1 The information and personal data that you provide to PPC S.A. (Data Controller) through the use of the PPC blue App are processed by authorized and lawfully licensed companies for the provision of all DEI blue® Services, APP functionality support, billing, payment, invoicing, troubleshooting and other eMobility services developed and provided via PPC blue App, as follows:

14.2 PPC SA and its authorized Partners process the information and personal data necessary for the provision of EΜobility services and the access to and use by the End User of the applications, websites, content, products and services provided by DEI blue®, such as but not limited to battery percentage and vehicle mileage, vehicle location via geolocation and charging status. The information and personal data collected are used to send:
a) personalized notifications related to the use and functionality of the services of the PPC blue Application and
b) personalized updates, either through the Application or by e-mail if you are a DEI blue® Member, for promotional actions of eMobility products by PPC S.A. or its Partners, under the conditions set by the legislative and regulatory framework. In this case, you may at any time exercise your right to opt-out by requesting to stop receiving the relevant updates.
14.3 Data base – Cyber Security Policies:
All user and charging station data are held and stored in databases that meet all security protocols provided by PPC's Cyber Security Division.

15. INTELLECTUAL PROPERTY
You acknowledge and agree that all intellectual property rights, trademarks and all other intellectual property rights related to all material, content and information including, but not limited to, procedures, working methods, software, drawings, texts, design and know-how, provided as part of the PPC blue App, belong at any time to PPC S.A. or to those who license their use to us. You are allowed to use such material only to the extent expressly authorized by PPC or its licensors.
16. VIRUSES, PIRACY AND OTHER CYBERCRIME
16.1. It is prohibited to make improper use of the PPC blue App by knowingly transmitting viruses, Trojan horses, worms and other malware or other materials that are malicious or technologically harmful. In addition, you are not allowed to gain unauthorized access to the PPC blue App and its server, or any other server, computer and database connected to the PPC blue App. You undertake the responsibility not to attack the PPC blue App through a denial-of-service attack or a distributed denial of service attack.
16.2 Breach of the above obligation under article 16.1 may constitute a criminal offence in accordance with the applicable legislation. Any such breach will be reported to the competent law enforcement authorities with whom PPC S.A. will cooperate and provide all necessary information in order to reveal the identity of the person who commits electronic infringement.
16.3 Similarly, in case of such a breach, your right to use the PPC blue App will be immediately terminated.
16.4. PPC S.A. shall not be liable for any technological failure, loss or damage caused by a denial-of-service attack, viruses or any other type of malware or technologically harmful material which may infect your computer, its components, data or any other material due to the use of the application or the downloading of material contained therein or similar material of any other website to which the application links.
17. LINKS IN ΤΗΕ APPLICATION
The PPC blue App may contain links to other websites and sources provided by third parties. These links are provided solely for informational purposes, while the content of these websites or sources is in no way under the control of PPC S.A. Consequently, PPC S.A. bears no responsibility whatsoever for any loss or damage that may be caused by the use of these links.
18. APPLICABLE LAW - JURISDICTION
The use of the PPC blue App, as well as the Agreements for the provision of DEI blue® Services are governed by Greek law. Any dispute or claim arising from or related to the use of the PPC blue App and/or the said Agreements is subject to the exclusive jurisdiction of the courts of Athens.
19. OTHER TERMS
19.1 These Terms constitute the entire agreement between you and PPC S.A. in relation to its subject matter.
19.2. Invalidity of any of the Terms does not affect the validity of the terms as a whole and the DEI blue® Service Agreement shall continue to bind the Parties with regard to its valid part.
19.3 The Parties acknowledge that for the conclusion of the DEI blue® Service Agreement, none of them relied on any representation, undertaking or promise of the other Party.
ANNEX A
1. INSTALLATION, OPERATION AND USE OF THE PPC blue APP
1.1. The PPC blue App is available free of charge through the digital application stores.
1.2. The PPC blue App can be downloaded on a compatible mobile electronic device using IOS or Android software.
1.3. The PPC blue App and the DEI blue® Website contain the Terms and Conditions of Use of the application. When entering the Application, you must first read and understand the Terms of Use.
1.4. The Application indicates in a clear and detailed manner all the steps to be followed and the data to be entered for proper use of the application. Instructions for the use of the DEI blue® services are also described on the DEI blue® Website.
1.5. Your acceptance of access of the application to your location, is necessary in order to be able to use the Application. The Application's access to your location through the transmission of geolocation data contributes exclusively to locate at any time your nearest Operational Charging Point and to the ability to start the charging session of your EV. Please note that any geolocation data will be deleted after you have finished using the Application.
1.6. PPC S.A. grants you the license to use the PPC blue App indefinitely in order to:
• Locate and examine the location of Operational and Non- Operational Charging Points of the DEI blue® Network,
• to access Operational Charging Points,
• pay for each Charging Session of your EV
• have access to additional E-Mobility services provided through special functionalities of the Application
1.7. When using the PPC blue App, you undertake the obligation:
1. not to make any false or fraudulent statements,
2. to provide PPC S.A. with true and accurate information and update it without delay, whenever there is any change in its content,
3. to comply strictly with the Safe Charging Rules, as set out in the relevant Annex to these Terms, and ensure that the devices you use (including your EV) comply with all technical specifications required for the use of the DEI blue® eMobility service and the holding of each Charging Session,
4. to comply with the present terms and the applicable legislation and inform PPC S.A. without delay, in case you detect any defect or error during the use of a Charging Point,
5. to inform PPC S.A., by any appropriate means, if you become aware of any unauthorized use, illegal storage, processing or exploitation of the application and/or DEI blue® services.
1.8 PPC S.A. is entitled to temporarily suspend your access to the DEI blue® Services and/or the PPC blue App for reasons of maintenance and/or updating of the systems and/or for the reasons provided for in the relevant articles. Furthermore, PPC S.A. is entitled to immediately suspend the use of the Application for reasons of compliance with any court or arbitration decision or in case this is required by the applicable legislation. In any of aforementioned cases, PPC S.A. will make every effort to inform you in advance. Exceptionally, if access to the DEI blue® Services is interrupted due to your wrongful act or omission, then you will be bound by the obligations arising from the applicable Terms.
1.9 The communication between the Parties in the context and for the purposes of the use of the DEI blue® Services and consequently the execution of the respective DEI blue® Service Agreement, shall be carried out by any appropriate means. PPC S.A. may communicate with you and inform you in the context and for the purposes of the provision of the DEI blue® Services through the Application and/or the DEI blue® Website. Any notice will be deemed to have been received as soon as it appears on the Application and the Website.
1.10 You may terminate your license to use the PPC blue App at any time by deleting the Application.
2. INAPPROPRIATE USE OF THE APPLICATION
2.1 Inappropriate use of the PPC blue App is considered to be any use of the application that is not described in these Terms and Conditions and may violate the rights of PPC S.A. and/or one or more third parties. Inappropriate use of the application may constitute a criminal offence committed by electronic means and may be reported at any time to the Police or other public authorities.
2.2 The license to use the PPC blue App is non-exclusive, personal, non-transferable and cannot be sub-licensed. During the use of the application, the following actions are prohibited:
1. selling, assigning, transferring, distributing, lending, using, leasing, or in any way making available to the public the application, and/or the software or any part thereof, to any third party not authorized by PPC S.A,
2. making the application available to third parties via peer-to-peer or other network or in any other way, as well as framing and/or mirroring of the application or the software or any part thereof,
3. copying, reverse engineering, and/or any other modification of the PPC blue App.
2.3 If you violate the above conditions under 2.2 or make inappropriate use of the application, PPC S.A. may revoke the license immediately and at any time, without prior notice/information.
ΑΝΝΕΧ Β - RULES FOR SAFE CHARGING
The charger placed at each Charging Point is intended for charging solely Electric Vehicles (EVs) compatible with Mode 3 AC Charging or Mode 4 DC Charging. The User should observe the following rules for a smooth and safe operation during each charging session:
- The use of the Electric Vehicles charger is not authorized for persons under the age of eighteen (18) years. Underage minors should not remain in Charging Stations for Electric Vehicles without parental or guardian supervision.
- During charging session, you may not engage in any process other than charging your Electric Vehicle.
- Before starting a charging session, you must read the charging instructions displayed at the Charging Point and follow the steps one-by-one. It is recommended to have been familiarized with the instruction’s manual of your Electric Vehicle before starting the Charging Session.
- Charging Points should only be operated if they are in perfect condition and are reported as available for use in the PPC blue App.
- If upon your arrival at a charging Point you notice any wear and tear or damage on the charger or the associated installations do not proceed with charging your Electric Vehicle. Step away from the Charging Point and call immediately the E-Mobility customer service at 800 900 1100, free of charge, from a landline or mobile phone, or at +30 211 211 0900 if you are calling from a foreign mobile phone line.
- It is expressly prohibited to connect any electrical or other devices or tools of any other type whatsoever to the charger. No other device should be interconnected to the cable that connects your Electric Vehicle to the charger.
- Use the cable of your Electric Vehicle’s manufacturer or an appropriate cable of another supplier that meets the specifications of your Electric Vehicle’s manufacturer, with CE certification.
- Before starting the Charging Session, thoroughly inspect the charging cable for any signs of damage or wear and tear. The cable’s contact surface should not come in contact with heat sources, flammable materials or water.
- Do not connect any extension cord to the charging cable.
- Always disconnect the charging cable from the plug holder by pulling the plug and not by pulling the charging cable itself.
- Handle the charging cable carefully. Do not touch the cable or the charger with wet hands.
- Do not attempt to touch the charger’s inlet with your fingers or any other object.
- Do not attempt to use any objects or other tools to unplug the charging cable.
- It is prohibited to use defective, worn or dirty sockets, plugs or terminals.
- Do not attempt to start up the engine of your Electric Vehicle when it is connected to the charger.
- Make sure you have removed the charging cable before you start up your Electric Vehicle.
- After ending a Charging Session drive your Electric Vehicle away from the Charging Point. Do not park your vehicle at the charging plug without cause. The Charging Point should remain unoccupied for the next Electric Vehicle driver.
- Charging Points using the Mode 3 AC Charging have no independent power switch accessible to users. The line circuit breaker of the supply line serves as a mains circuit breaker.
- Charging Points using the Mode 4 DC Charging have an emergency STOP. Furthermore, there is no independent power switch accessible to users. The line circuit breaker of the supply line serves as a mains circuit breaker.
- None other than authorized and specially qualified PPC staff is allowed to arbitrarily intervene, convert, modify or attempt to repair a Charging Point or the installed Charging Stations.
- It is prohibited to remove the instructions, safety signs, technical specifications, etc. from the Charging Station or the overall Charging Infrastructure.
